Terms of Use

1. Acceptance

By accessing or using the alpaviation.ch website (the "Website"), you agree to be bound by these Terms of Use. If you do not agree, please stop using the Website immediately.

These terms govern your use of the Website only. They are not a training contract, a rental agreement, a scenic-flight booking agreement, or an aircraft management agreement. Those relationships are governed by separate written contracts entered into directly with alpaviation ag or its partners.

alpaviation ag has operated as a flight training academy at Bern-Belp Airport (LSZB) since 1988. It is certified by the Federal Office of Civil Aviation (FOCA) and holds EASA Approved Training Organisation status under reference CH.ATO.0147.

3. Services overview

alpaviation ag provides the following services, which may be enquired about or booked through the Website:

Flight training — modular EASA pilot training programmes including LAPL(A), PPL(A), CPL(A), ATPL(A) integrated, instrument ratings (IR, CB-IR, EIR), night ratings, class and type ratings, instructor ratings (FI, CRI, IRI, TRI), and upset prevention and recovery training (UPRT).
Scenic flights — scenic and sightseeing flights departing from Bern-Belp Airport over the Swiss Alps and surrounding regions.
Aircraft rentals — wet and dry hourly or block hire of aircraft from our fleet for qualified pilots.
Aircraft management — aircraft registration, airworthiness management, and maintenance coordination, performed in partnership with AIRMATEC AG (see section 9).
Aviation consulting — expert advice for individuals and organisations on EASA regulatory matters, fleet planning, and pilot career development.

Enquiries and expressions of interest submitted through the Website do not constitute a binding booking or contract. All training programmes, rentals, scenic flights, and management agreements are governed by separate written agreements that will be provided to you before any service commences.

4. Permitted use of the Website

You may use the Website for lawful purposes and in accordance with these terms. You agree not to:

Use the Website in any way that violates applicable Swiss or EU law.
Attempt to gain unauthorised access to any system, server, or database connected to the Website.
Transmit unsolicited commercial communications (spam) through any form on the Website.
Submit false or misleading information through any contact form or enquiry.
Reproduce, copy, scrape, or redistribute content from the Website without prior written consent (see section 6).
Use automated tools to systematically extract data from the Website.

We reserve the right to restrict or terminate access to the Website for users who breach these terms.

5. Account registration

User accounts are not currently required to access the Website. A future student portal requiring account registration is planned. When that feature is introduced, separate registration terms will be presented at signup and will supplement these Terms of Use.

6. Intellectual property

All content on the Website — including text, graphics, photographs, logos, layout, software, and source code — is either owned by alpaviation ag or used with the permission of the rights holder, and is protected under Swiss and international copyright law.

You may view, print, and download content for your personal, non-commercial use only. Any other reproduction, redistribution, or commercial use requires the prior written consent of alpaviation ag.

The following marks and references appear on the Website and remain the property of their respective owners:

EASA and FOCA are regulatory bodies; references to their certification schemes are factual and do not imply endorsement of content beyond the scope of the relevant approvals.
AIRMATEC AG is an independent company holding EASA Part-145 approval CH.145.0318. Its name appears in the context of our maintenance partnership.
SPHAIR is a Swiss Armed Forces officer candidate flight training programme. References to our partnership are factual.
Other third-party brand names and logos appearing on the Website are the property of their respective owners.

7. User-submitted content

When you submit a contact form, newsletter signup, booking enquiry, or any other form on the Website, you confirm that the information you provide is accurate, that you are authorised to provide it, and that you are not submitting content that is unlawful, defamatory, or infringing of any third-party rights.

We will handle all personal data you submit in accordance with our Privacy Policy at /privacy.

We do not currently host user-generated public content (forums, reviews, comment sections). If such features are introduced, separate content guidelines will apply.

8. Third-party links

The Website contains links to external websites and resources, including FOCA (bazl.admin.ch), EASA (easa.europa.eu), and partner organisations. These links are provided for your convenience. alpaviation ag has no control over the content or practices of external sites and accepts no responsibility for them. Visiting a third-party site is at your own risk, and you should review their terms and privacy policies independently.

9. Disclaimers

Training information and licence eligibility

Information on this Website about training programmes, EASA licence pathways, and career routes is provided for general guidance only. It is not a guarantee of eligibility, successful completion, or employment outcomes. Eligibility for any EASA licence or rating is determined by FOCA and EASA requirements in force at the time of application, and may be subject to medical fitness standards, minimum flight hour requirements, and examination results.

LAPL — important notice

The LAPL(A) (Light Aircraft Pilot Licence) is an EASA licence valid within EASA member states only. It is not recognised for flight operations outside EASA states (e.g., the United Kingdom post-Brexit, the United States, or other non-EASA jurisdictions). Applicants who intend to fly internationally should consider the PPL(A), which is issued under ICAO Annex 1 and widely recognised, or discuss requirements for their target jurisdiction with our instructors before enrolment.

Aircraft availability and pricing

Aircraft availability and pricing published on the Website are indicative and subject to change without notice. Confirmed pricing and availability are provided in writing at the point of booking.

Scenic flights — weather and safety

Scenic flights operate subject to weather conditions, airspace availability, and the safety assessment of the operating crew. alpaviation ag reserves the right to cancel, postpone, or modify any scenic flight at any time if safety or regulatory conditions require it. We will make reasonable efforts to offer an alternative date or a refund in accordance with our booking terms.

Aircraft maintenance — AIRMATEC AG

Aircraft owned or managed by alpaviation ag are maintained by our partner AIRMATEC AG (Flugplatzstrasse 19, 3123 Belp; EASA Part-145 approval reference CH.145.0318). alpaviation ag is itself not an EASA Part-145 approved maintenance organisation. Maintenance services are performed exclusively by AIRMATEC AG under its own approval.

10. Limitation of liability

To the maximum extent permitted by Swiss law:

alpaviation ag provides the Website and its content on an "as is" and "as available" basis. We make no warranties, express or implied, as to the accuracy, completeness, or fitness for any particular purpose of the content on the Website.

alpaviation ag shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the Website or its content.

Mandatory Swiss law exceptions: nothing in these terms limits or excludes liability for (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under Swiss law, including gross negligence and intentional misconduct (Swiss CO Art. 100, 101). Where Swiss mandatory law applies, these terms are interpreted to comply with it.

The above limitations apply to liability in contract, tort, and any other cause of action, to the fullest extent permitted by applicable law.

11. Indemnification

You agree to indemnify and hold harmless alpaviation ag, its officers, employees, and agents from and against any claim, loss, liability, or expense (including reasonable legal costs) arising from your breach of these Terms of Use or your use of the Website in a manner that causes loss to a third party.

12. Termination

We may suspend or terminate your access to any part of the Website at any time without notice if we believe you have breached these terms or if we are required to do so by law. Termination of access does not affect any right or obligation that arose before termination.

13. Governing law and jurisdiction

These Terms of Use are governed by and construed in accordance with Swiss law, without regard to its conflict-of-laws provisions.

Any dispute arising from or in connection with these terms or the Website shall be subject to the exclusive jurisdiction of the courts of Bern, Switzerland.

Consumer protection: if you are a consumer resident in an EU member state, you retain the benefit of any mandatory consumer protection provisions of the law of your country of domicile that cannot be contractually disapplied. The above jurisdiction clause does not deprive you of those protections.

14. Changes to these terms

We may update these terms from time to time. We will post the revised terms here with an updated "Effective date." Where changes are material, we will make reasonable efforts to notify registered users. Continued use of the Website after the effective date of any change constitutes acceptance of the revised terms.
